All orders placed through the Site are subject to Show Some Pluck’s acceptance. This means that Show Some Pluck may refuse to accept or may cancel any order, whether or not the order has been confirmed, for any or no reason, and without liability to you or anyone else. If your credit card has already been charged for an order that is later cancelled, Show Some Pluck will issue you a refund.

You are responsible for any actions that take place while using your Show Some Pluck account. All items purchased from Show Some Pluck are made pursuant to a shipment contract, FOB Show Some Pluck. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

If the specified prize becomes unavailable due to unforeseen circumstances, Show Some Pluck may substitute a prize of like or equal value. Show Some Pluck may launch contests requiring entrants to send in photo, text or other content for display on the Site which will be judged entirely at the sole discretion of Show Some Pluck. By submitting any photo or information to Show Some Pluck, you hereby grant to Show Some Pluck and its affiliates, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted photo or other information in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. By submitting any photo or information to the Site or Show Some Pluck, you hereby represent and warrant that the submitted photo or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and you have the right to grant any and all rights and licenses granted to Show Some Pluck herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances. You acknowledge and agree that Show Some Pluck shall have no obligation to post, display or otherwise make publicly available any photo or information submitted by you, and may, in its sole and unfettered discretion, remove, edit, modify or delete any photo or information that you submit to the Site.

You understand and intend that any photo or information submitted by you to Show Some Pluck may be available for viewing, rating, review and comment on by the public on the Site, and understand that comments or ratings with which you disagree or are unhappy about may be published or otherwise become associated with any photo or information you submit to the Site. By submitting any photo or information to Show Some Pluck, you hereby waive any privacy expectations that you may have with respect to any such photo or information submitted by you to the website. 12.  Applicable Law

By visiting the Site, you agree that this Site shall be deemed a passive website solely based in California, which does not give rise to personal jurisdiction over Show Some Pluck in jurisdictions other than California.  You agree that this Site, Terms and Conditions, Privacy Policy and any dispute between you and Show Some Pluck or its affiliates shall be governed in all respects by California law, without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. Except where prohibited, you agree that all disputes, claims and legal proceedings directly or indirectly arising out of or relating to this Site (including but not limited to the purchase of Show Some Pluck products) shall be resolved individually, without resort to any form of class action, and exclusively in the state or federal courts located in San Francisco County, California.  You consent to waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the state and federal courts of San Francisco County, California. Any cause of action or claim you may have with respect to the Site (including but not limited to the purchase of Show Some Pluck products) must be commenced within one (1) year after the claim or cause of action arises.

13.  Dispute Resolution

Any dispute relating in any way to your visit to the Site or to products you purchase through the Site, a retail shop, or through Show Some Pluck, directly, shall be submitted to confidential arbitration in San Francisco, California, except that, to the extent you have in any manner violated or threatened to violate Show Some Pluck’s intellectual property rights, Show Some Pluck may seek injunctive or other appropriate relief in any state or federal court in the state of California, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Terms and Conditions shall be joined to an arbitration involving any other party subject to these Terms and Conditions, whether through class arbitration proceedings or otherwise.

14.  Modification and Severability

Show Some Pluck reserves the right to make changes to the Site, policies, and these Terms and Conditions at any time. MOBILE SERVICES

PUBLISHED ACTIVITY

Show Some Pluck allows you the option to publish about the actions you take on the Site to Facebook, Twitter and other social platforms. Show Some Pluck does not control which information gets disseminated on participating social platforms. You agree to allow Show Some Pluck to check your Show Some Pluck cookies when you are visiting participating social platforms, and allow Show Some Pluck to receive information about your use of those social platforms. You can deactivate this publishing feature on your profile page.

TERMINATION

Show Some Pluck reserves the right in its sole discretion to terminate your account, delete your profile and any of your User Generated Content, and restrict your use of all or any part of the Site for any or no reason, without notice, and without liability to you or anyone else.
